1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Crush Dispensary ("Crush," "we," "us," or "our") governing your access to and use of the website located at www.crushdispensary.com (the "Site") and any related services, including online ordering, loyalty programs, and customer communications.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site, with an updated "Effective Date." Your continued use of the Site after any modification constitutes your acceptance of the updated Terms.

2. Age Restriction & Legal Eligibility

YOU MUST BE AT LEAST 21 YEARS OF AGE (or 18 years of age with a valid state medical cannabis patient card, where applicable) to access this Site, create an account, or purchase any product.

By using this Site, you represent and warrant that:

• You are of legal age to purchase cannabis in the jurisdiction where you reside and where products will be delivered or picked up

• You are not prohibited from purchasing or possessing cannabis under any applicable law • You will provide accurate and truthful age and identity information upon request • You understand that cannabis products may only be used in jurisdictions where legal

We reserve the right to require age verification documentation at any time and to refuse service to anyone who cannot verify their legal eligibility. Any attempt to access our Site or purchase products while underage is strictly prohibited and may be reported to appropriate authorities.

3. Legal Use & Compliance

Cannabis is a controlled substance under federal law. Our products are sold exclusively under state and local cannabis licenses and are intended for lawful use within the licensed jurisdiction only. By purchasing from Crush Dispensary, you agree that:

• You will not resell, redistribute, or transfer cannabis products to any third party • You will not use or allow use of our products by anyone under the legal age • You acknowledge that cannabis products may impair your ability to drive or operate machinery

Crush Dispensary is not responsible for any use of its products in violation of applicable law. All sales are final subject to applicable state law requirements regarding returns.

4. Account Registration

To access certain features of our Site, including online ordering and loyalty rewards, you may be required to create an account. You agree to:

• Provide accurate, current, and complete registration information

• Maintain the security of your account credentials and not share your password • Notify us immediately of any unauthorized access to your account

• Accept responsibility for all activities conducted through your account

We reserve the right to terminate or suspend any account at our sole discretion, including for violation of these Terms, suspected fraudulent activity, or failure to meet age verification requirements. You may not create an account on behalf of another person.

5. Online Ordering & Purchasing

5.1 Order Acceptance

Placing an order on our Site constitutes an offer to purchase, not a binding contract. We reserve the right to accept or decline any order for any reason, including product availability, pricing errors, or failure to verify age or identity. Orders are confirmed only upon our explicit acceptance and payment processing.

5.2 Pricing & Product Availability

All prices are displayed in U.S. dollars and are subject to applicable cannabis excise taxes, sales taxes, and any other government-mandated fees. We reserve the right to change prices at any time without notice. Product availability is subject to inventory and may change without notice. We are not responsible for typographical errors in pricing or product descriptions.

5.3 Payment

We accept payment methods as listed at checkout. By providing payment information, you represent that you are authorized to use the payment method. All transactions are processed securely through our payment processors. We do not store full credit card or debit card numbers.

5.4 Cannabis Purchase Limits

All purchases are subject to applicable state cannabis possession and purchase limits. We will not process orders that exceed the legal daily or transaction limits established by state law. It is your responsibility to ensure that your total possession does not exceed legal limits.

5.5 Pick-Up & Delivery

Orders placed online may be fulfilled through in-store pick-up or delivery, as available. Delivery is subject to geographic restrictions, applicable licensing, and state law. A valid government-issued ID confirming legal age must be presented at the time of pick-up or delivery. We reserve the right to cancel any order if age or identity cannot be verified at the time of fulfillment.

6. Returns, Refunds & Exchanges

Due to the nature of cannabis products and applicable state regulations, all sales are generally final. We do not accept returns of opened cannabis products. However, if you receive a product that is defective, mislabeled, or materially different from what was ordered, please contact us within 48 hours of purchase and we will work with you to resolve the issue in accordance with applicable law.

Refunds, if issued, will be provided in the same form as the original payment. We reserve the right to refuse returns that do not comply with state regulations or our policies.

7. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of Crush Dispensary or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, transmit, or create derivative works from any content on this Site without our express written permission. Limited permission is granted to access and use the Site for personal, non-commercial purposes only.

8. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms

• Attempt to gain unauthorized access to any portion of the Site or any systems connected to it

• Use automated tools, bots, scrapers, or scripts to access or collect data from the Site • Post or transmit any content that is fraudulent, misleading, harmful, or unlawful • Impersonate any person or entity or misrepresent your age, identity, or affiliation • Interfere with or disrupt the integrity or performance of the Site or related systems • Circumvent any age verification, geo-restriction, or security measures

• Resell or misuse any products purchased from Crush Dispensary

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CRUSH DISPENSARY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components. Product descriptions, effects, and potency information are for informational purposes only. Individual experiences with cannabis products may vary. Consult a qualified healthcare professional before using cannabis products, especially if you are pregnant, nursing, or have a medical condition.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRUSH DISPENSARY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PRODUCTS OR SERVICES PURCHASED THROUGH IT.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Crush Dispensary and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or purchase of products; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any misrepresentation you make in connection with your use of our services.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which Crush Dispensary holds its cannabis retail license, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall first be subject to informal resolution by contacting us directly. If informal resolution is unsuccessful, disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt out of arbitration within 30 days of first accepting these Terms by contacting us in writing.

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class or collective action. You waive any right to participate in a class action lawsuit or class wide arbitration.

13. Third-Party Links & Services

Our Site may contain links to third-party websites or integrate third-party services (including our SWEED-powered e-commerce platform). These links are provided for convenience only. We are not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of any third-party site is at your own risk and subject to that site's terms and policies.

14. Termination

We reserve the right to terminate or suspend your access to the Site and any accounts at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, all provisions of these Terms that by their nature should survive will remain in effect, including without limitation, intellectual property provisions, disclaimers, indemnification, and limitations of liability.

15. Entire Agreement & Severability

These Terms, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and Crush Dispensary with respect to your use of the Site and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
